Constitution of the Nation-State of Froúrio

The constitution of Froúrio establishes the nation-state of Froúrio and has jurisdiction over the islands that constitute Froúrio nisí. The constitution was replaced following the fall of Froúrio in the autumn of 4706 and is considered revolutionary in its treatment of citizenship and indenture.   This document supercedes the First Constitution of Froúrio following the fall of Froúrio.

Purpose

The constitution serves as an aggregate of the fundamental principles that constitute the legal basis of the city-state of Froúrio. It serves to establish precedents and along with subsequently codified laws establish how the city-state is to be governed.

Creation of the State
Defines the city-state as the entire island complex of Froúrio nisí.

Establishes the desireability of direct democracy.
Individual equality and dignity
Establishes the equality of all individuals regardless of race, gender, ethnicity, disability, or social class.
Service to the State
Frames the rationale and obligations of citizens to vote and otherwise serve the state interests.

Article 1 - Citizenship, Residency and Indenture

Citizenship
Establishes the pre-requisites of citizenship (citizens).
Residency
Also establishes the pre-requisites, terms and procedures of residency (metics).
Other Inhabitants
Defines status of other non-citizen, non-resident inhabitants and establishes the duty to obey the laws of Froúrio.
Indenture
Defines indenture and establishes what conditions an individual may become indentured/lose the rights of citizenship or residency, acceptable terms of service and procedures for manumission.

Article 2 - Rights and Priviledges

Rights of property
All citizens and residents shall have the right to have property and to possess, use and dispose of it individually and jointly with other persons.
Rights of mariage
All citizens and residents shall have the right to marry. Marriage shall be based on mutual consent of both parties and maintained through mutual cooperation with equal rights as a basis.
Rights of education
All citizens and residents shall have the right to an education provided by the state.
Freedoms of assembly
All citizens and residents shall have the right to peaceably to assemble, and to petition the Government for a redress of grievances.
Freedoms of association
All citizens shall have the right to establish societies or political parties provided their objective is lawful, their methods peaceful, and their rules and terms of membership in compliance with the constitution.
Freedoms of movement
All citizens and residents have the right to freedom of movement within Froúrio.

Article 3 - Responsibilities

Duty to pay taxes
All people shall be liable to taxation as provided by law.
Duty to serve
All people have the obligation to defend the country and render national service when called upon to do so.
Duty to labor
All people shall have the right and the obligation to work.
Duty to vote
All people shall have the right and the obligation to vote in election of officials.
Duty to serve on Juries
All people shall have the right and the obligation to serve on a jury of their peers.

Article 4 - Drafting of Laws

Allows for any citizen to put forth initiatives, referendums and suggestions for laws. Establishes a committee of citizens responsible for finald rafting, review, approval and amending laws. Defines the term of membership of the committee, procedures, powers and limits of the committee.

Article 5 - Administration and Enforcement of Laws

Citizen offices
Establishes citizen offices responsible for execution and administration of laws. Defines the term of each office and its procedures, powers and limits.
Oversight
Establishes a separate citizen oversight committee for oversight of citizen offices. Only this committtee can bring charges against holders of an office in the pursuit of their duties. These charges are adjudicated by jury as per Article 6.

Article 6 - Adjudication of Laws

Establishes the system of juries, their jurisdiction, limitations of judgement and rights of appeal.

Article 7 - Precedence

This article establishes the laws and treaties made in accordance with this constitution as the supreme law of the land.

Article 8 - Amendment

This section outlines the procedures for ammendment of the constitution through a vote requiring a supermajority of all citizens.

The document is in draft form and is unratified.

Legal status

The constitution is valid from signature and covers the city-state of Froúrio as well as the entire island complex of Froúrio nisí. It does not cover Eleusis.

Historical Details

Background

The original constitution of Froúrio remained in effect until the fall of the city and death of its citizenry in the fall of 4706. Using a failsafe enchantment in the existing constitution, a new group of citizens were nominated from the defenders who saved the island from total destruction.   During the reconstruction of the city, the new constitution was drafted. Input was provided not only by the new citizens but also from Phlios Meletitís, an elder statesman and pro-democracy reformer in exile from Astériapólis.   The new constitution represents the withdrawl of the city-state from the Drákon League and the establishment of a separate power.

Public Reaction

Froúrio reaction to be determined.   The establishment of a separate nation-state was rejected by the member states of the Drákon League and military force was used to bring the vassal city-state back in line.

Term

The document is in force from signature. It can be ammended through the process defined in the constitution. This document became obsolete with the death of all of its citizens and the fall of the state.
